By using AviaryID (hereinafter "the Application"), you unreservedly accept these Terms of Service (ToS). If you do not accept, please do not use the Application.

1. Definitions

User:Any person using the Application.

Owner:User who has registered a bird.

Finder:User reporting a found bird.

Service:Application features (identification, alerts, community, etc.).

2. Purpose

AviaryID is a mobile application that allows:

•Registration and identification of birds via markings (bands, tattoos, microchips)

•Connecting owners and finders

•Prevention of theft and loss

•Exchange within an avian community

3. Service Access

•The Application is free (basic version).

•A Premium version is available via subscription (details in the app).

•Minimum age: 16 years (or parental authorization).

•Compatible with iOS 14+ and Android 8+.

4. Account Creation

•Required to use the Service.

•You agree to provide accurate and up-to-date information.

•One account per person.

•Prohibited to create an account for others without authorization.

5. User Obligations

You agree to:

•Not impersonate another user

•Not register a bird you do not legally own

•Not use the Application for commercial purposes without agreement

•Respect laws (no illegal, defamatory, hateful content)

•Report any abusive use via support@aviaryid.com

6. Intellectual Property

•The Application, its name, logo, and features are protected by copyright and trademarks.

•No reproduction or exploitation without written authorization.

7. Liability

AviaryID is not responsible for:

•False information provided by users

•Disputes between users (e.g., contested ownership)

•Indirect damages (emotional loss, etc.)

We implement all means to ensure the availability and security of the Service, without absolute guarantee.

8. Reporting a Lost or Found Bird

•In case of false declaration, your account may be suspended or deleted.

•Proof of ownership (invoices, certificates) may be requested.

•AviaryID may transmit data to authorities in case of reported theft.

9. Community Moderation

Forums, chats, and comments are moderated a posteriori.

Prohibited content:

•Insults, threats, harassment

•Unauthorized advertising

•Shocking or illegal content

Sanctions: warning → suspension → permanent deletion.

10. Premium Subscription

•Payment via App Store or Google Play.

•Automatic renewal (can be disabled in store settings).

•Refund: according to store policies (not managed by AviaryID).

•Cancellation anytime → access maintained until end of paid period.

11. Account Termination

You can delete your account at any time:

Settings → My Account → Delete my account

➡️ All your data is deleted within 30 days (except legal obligations).

We may terminate your account in case of:

•ToS violation

•Fraudulent activity

•24 months of inactivity

12. ToS Modifications

•Any update is notified in the Application.

•Your continued use constitutes acceptance.

•In case of refusal, you must stop using the Application.

13. Applicable Law and Jurisdiction

•French law

•Competent courts: those of AviaryID's registered office

•In case of dispute, prior amicable mediation attempt
